Terms of Use

1. This agreement

Jenase is published by Ad Prospera, Inc., a Delaware corporation ("Ad Prospera", "we", "us"). These Terms of Use are the agreement between you and Ad Prospera covering the Jenase iPhone app and the jenase.com website (together, the "Service").

By downloading, opening or using Jenase, you agree to these terms. If you do not agree, do not use the Service.

2. What Jenase does

Jenase is a speech and public-speaking practice tool. You read a passage aloud or speak freely on a topic while the app tracks your words in real time, then it produces a scored report: an overall score, a rank, a sub-skill breakdown, automatically generated coaching tips, a word-by-word breakdown and playback of your take. It also keeps daily goals, streaks and progress analytics.

Scores and coaching tips are generated automatically and are meant as practice feedback. They are not professional advice, and Jenase is not a medical device, a diagnostic tool, or a substitute for a speech-language pathologist, a voice coach, or any other qualified professional.

We may change, add or remove features over time. We may also stop offering the Service, and we will give reasonable notice if we do.

3. Eligibility

You must be at least 13 years old to use Jenase. If you are under the age of majority where you live, you may use Jenase only with the involvement of a parent or legal guardian, who agrees to these terms on your behalf.

Jenase does not have user accounts. You do not create a login, and we do not issue you credentials. Your practice history lives on your device.

4. Your free session

Jenase includes one free practice session per person, so you can try a full session and see a real report before deciding whether to subscribe. Because the count is tied to your practice history, which syncs through your own iCloud account, the free session does not reset by deleting and reinstalling the app or by moving to another device.

After that session, a Jenase Pro subscription is required to start new sessions.

5. Jenase Pro and billing

Jenase Pro is an auto-renewing subscription sold through Apple as an in-app purchase. Two plans are offered:

  • Monthly — $9.99 USD per month.
  • Yearly — $59.99 USD per year, which begins with a 3-day free trial.

Prices are shown in US dollars and may differ by region and currency. The price shown to you in the app at the moment of purchase is the price that applies. We may change prices for future billing periods; Apple will notify you as required and you may cancel before the change takes effect.

How billing works

  • Payment is charged to your Apple ID when you confirm the purchase.
  • The subscription renews automatically at the end of each billing period unless you cancel it.
  • Your Apple ID is charged for renewal within 24 hours before the current period ends, at the then-current price for your plan.
  • The 3-day free trial converts into a paid yearly subscription unless you cancel at least 24 hours before the trial ends. If you buy a subscription during a free trial, the unused portion of the trial is forfeited.
  • Free trials are limited to one per Apple ID and are subject to Apple's eligibility rules.

Cancelling

You can cancel at any time in iOS Settings → your name → Subscriptions, or through the Subscription section inside Jenase, which opens the same screen. Cancel at least 24 hours before the end of the current period to avoid being charged for the next one. Cancelling stops future renewals; you keep Pro access until the end of the period you already paid for.

Refunds

Because Apple processes the payment, Apple handles refunds. We cannot issue refunds for App Store purchases. Request one at reportaproblem.apple.com. Except where a refund is required by law, payments are otherwise non-refundable, and partial periods are not prorated.

Restoring a purchase

If you reinstall Jenase or set up a new device, use Restore Purchases in the app's Settings to bring back an active subscription tied to your Apple ID.

6. Your scripts and recordings

Anything you write, paste or record in Jenase — your scripts, your audio, your session results — is yours. You keep all rights to it. We do not claim ownership, and we do not use it to train models.

These materials are stored on your device and, if you have iCloud enabled, in your own private iCloud storage, which we cannot access. During a session, live microphone audio is streamed to our transcription provider purely to convert speech to text in real time. See the Privacy Policy for the specifics.

You are responsible for what you put into the app. Do not upload text you do not have the right to use, and do not record other people without their consent.

7. Acceptable use

Use Jenase for its intended purpose: practising your own speaking. You agree not to:

  • Break the law, infringe anyone's rights, or record people without their permission where consent is required;
  • Reverse engineer, decompile, or attempt to extract source code, models, keys or credentials from the app, except where that restriction is prohibited by law;
  • Interfere with, overload, or attempt to gain unauthorised access to the Service or the systems behind it;
  • Use the Service to build a competing product, or to resell, sublicense or redistribute access to it;
  • Circumvent the free-session limit, the subscription gate, or any other technical restriction;
  • Use automated means to submit audio or text at a volume or rate that a person could not reasonably produce.

We may suspend or end your access if you do any of these things.

8. Our intellectual property

The Jenase app, the website, the built-in library of passages and drills, the scoring system, the name "Jenase", and the design and branding of the Service are owned by Ad Prospera and protected by intellectual property law. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use Jenase on Apple devices you own or control, for your own non-commercial practice. No other rights are granted.

9. Third-party services

Jenase relies on a small number of third parties: Apple for distribution and payment, ElevenLabs for real-time speech transcription, RevenueCat for subscription state, and PostHog for anonymous product analytics. Your use of the App Store is also governed by Apple's own terms. We are not responsible for third-party services we do not control, though we choose them carefully and describe exactly what each one receives in the Privacy Policy.

Apple is not a party to these terms and has no obligation to provide support for Jenase. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Ad Prospera disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Speech recognition is imperfect. We do not warrant that transcription will be accurate, that scores or coaching tips will be correct or suitable for you, that the Service will be uninterrupted, secure or error-free, or that it will produce any particular improvement in your speaking. You use it at your own discretion and risk.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Ad Prospera and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunities, or loss of goodwill, arising out of or relating to your use of the Service — even if we have been advised that such damages are possible.

Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for Jenase in the twelve months before the claim arose, or fifty US dollars ($50).

These limits apply regardless of the legal theory and even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12. Termination

You can end this agreement at any time by cancelling any subscription and deleting the app. We may suspend or terminate your access if you materially breach these terms or if we are required to do so by law. Sections 6 and 8 through 14 survive termination.

13. Changes to these terms

We may update these terms as Jenase changes. When we do, we will revise the effective date at the top of this page, and for material changes we will give notice in the app or by another reasonable means before the change takes effect. Continuing to use the Service after that means you accept the updated terms. If you do not accept them, stop using the Service and cancel any subscription.

14. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Service, and you consent to their jurisdiction and venue. If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection law in your country of residence.

If any provision of these terms is held unenforceable, the rest remains in effect.
